These Terms and Conditions govern your purchase and use of our custom-made gumshields, sold via our Shopify store. By purchasing our products, you agree to the following terms:
CONSENT
Non-Dental Status
I understand that Sporting Protection LTD and its representatives are not qualified dental or medical professionals, and do not provide medical or dental advice, diagnosis, or treatment.
Nature of the Product – Novelty Item
I understand that the gumshield provided is a novelty item. It has not undergone safety or impact testing and is not a certified protective device. Although it may be worn by athletes, it is not guaranteed to offer any protection against injury or trauma.
Use at Own Risk
I accept all risks associated with the impression process and use of the gumshield, including discomfort, gag reflex, irritation, allergic reaction, or dental injury. I also accept full responsibility for any injuries or trauma sustained while wearing the gumshield, including during sports or physical activity.
Dental Work – No Liability
I confirm that I have disclosed any existing dental work such as crowns, veneers, bridges, implants, composite bonding, dentures, braces, or retainers. I understand that Sporting Protection LTD accepts no responsibility for any damage to such dental work during the moulding process, fitting, or use of the gumshield.
Limitation of Liability
To the fullest extent permitted by law, I agree that Sporting Protection LTD, including its owners, employees, and agents, shall not be liable for any injury, damage, distress, or death, or for any indirect or consequential damages related to the services or product.
Indemnification
I agree to fully indemnify and hold harmless Sporting Protection LTD from all claims, legal actions, costs, or damages arising from the impression process, the supply or use of the gumshield, dissatisfaction with the product, or any injury or damage caused.
Severability
If any part of this agreement is found to be invalid or unenforceable, the rest of the agreement shall remain effective and enforceable.
Legal Age and Voluntary Consent
I confirm I am at least 18 years old, or that I am the legal parent or guardian signing on behalf of a minor. I give this consent voluntarily and understand all associated risks.
1. General
1.1. Sporting Protection Ltd (referred to as “we,” “us,” or “our”) specializes in producing custom-made gumshields.
1.2. These terms constitute a legally binding agreement between Sporting Protection Ltd and the customer (referred to as “you” or “your”).
1.3. All orders are subject to acceptance by us.
2. Ordering Process
2.1. Upon purchasing a gumshield, we will send you a mould kit, which includes instructions and/or a video tutorial for creating your dental impression.
2.2. The mould kit will be dispatched within 1-3 business days after your order is confirmed.
2.3. You are responsible for creating your dental impression correctly, following the instructions provided.
3. Returning the Mould Kit
3.1. You are required to send the completed mould kit back to us for processing.
3.2. The cost of returning the mould kit is your responsibility and is not included in the price of the gumshield.
3.3. If the mould you send is unsuitable for production (e.g., damaged, incomplete, or improperly done), you will be required to purchase a replacement mould kit at an additional cost before we can proceed with production.
4. Gumshield Production
4.1. Upon receiving your suitable mould, we will create your custom gumshield within 1-2 weeks, depending on our current workload.
4.2. If the mould provided is unsuitable for production, we will notify you and pause the order until a replacement mould is received.
4.3. Custom artwork will be applied based on the design you provide. However, we reserve the right to adjust designs or substitute images to ensure the best results.
5. Payment and Pricing
5.1. Payment must be made in full at the time of purchase.
5.2. All prices displayed on our Shopify store include VAT where applicable.
5.3. Additional charges, such as postage for returning the mould kit or purchasing replacement kits, are not included in the product price.
6. Refunds and Cancellations
6.1. Due to the custom nature of our gumshields, refunds or cancellations are not accepted once production has started.
6.2. If the moulding process is unsuccessful due to customer error and you choose not to proceed with the order, we will deduct £15 from the total amount paid to cover the cost of the mould kit. For example, if your order total was £90, you will receive a refund of £75.
6.3. If you wish to continue with your order after an unsuitable mould is sent, you must purchase a replacement mould kit at an additional cost.
6.4. We are not responsible for improper moulds or design inaccuracies caused by customer errors during the moulding process or submission of design details.
7. Shipping and Delivery
7.1. The mould kit will be dispatched to the shipping address provided at checkout.
7.2. Once your gumshield is completed, it will be shipped to you using the delivery method selected at checkout.
7.3. We are not responsible for delays caused by postal services or third-party couriers.
8. Liability
8.1. Sporting Protection Ltd is not responsible for injuries, damages, or other issues arising from the use of our gumshields or mould kits.
8.2. The gumshields are for personal use only and are not intended for resale.
8.3. We are not liable for delays due to unforeseen circumstances, such as postal disruptions or supplier issues.
9. Intellectual Property
9.1. All designs, logos, and trademarks provided by you for customization must not infringe on any third-party rights.
9.2. By submitting a design, you grant Sporting Protection Ltd a non-exclusive right to use it for the purpose of creating your gumshield.
10. Changes to Terms
10.1. We reserve the right to update these Terms and Conditions at any time without prior notice.
10.2. The version in effect at the time of purchase will govern your transaction.
